Terms of Service.

You must be at least 13 years old (or the minimum age required in your country) to create an account. If you use the App's navigation features while operating a motorcycle or other vehicle, you must hold a valid licence and meet the legal age and requirements to operate that vehicle in your jurisdiction. By using the App you represent that you meet these requirements and that the information you provide is accurate.

• You register with an email address and password and verify your email via a one-time code (OTP).
• You are responsible for keeping your credentials confidential and for all activity under your account.
• Notify us immediately at support@navigatemoto.com if you suspect unauthorized use of your account.
• You may not share, sell, or transfer your account, or create an account using false information or on behalf of someone else without authorization.

NavigateMoto provides, depending on your subscription tier:

• Maps, place search, route planning, and turn-by-turn navigation;
• Trip tracking, a live trip meter, ride history, and analytics;
• Offline map downloads;
• Weather information;
• Social features: posting and joining trips, trip join requests, reviews and ratings, profiles, and people search;
• Expense tracking;
• Optional features such as group ride tools and Emergency SOS (where offered).

We may add, change, suspend, or remove features at any time. Some features require a paid subscription (see Section 7) and may depend on third-party services, connectivity, GPS availability, and your device.

YOUR SAFETY IS YOUR RESPONSIBILITY. This section covers navigation and riding. By using the App you acknowledge and agree:

• Do not interact with, hold, or stare at your device while riding or driving. Set your destination before you start moving, mount your device securely, and use voice guidance.
• Always obey all traffic laws, road signs, signals, posted speed limits, and actual road conditions. App instructions, speed-limit data, and routes may be inaccurate, incomplete, outdated, or unsuitable, and DO NOT override real-world conditions or the law.
• Routes, distances, estimated times, maps, and traffic/weather data are provided for convenience only, are not guaranteed, and may contain errors. Use your own judgment.
• The App is NOT a substitute for safe riding practices, proper gear, attention to your surroundings, or licensed driving.
• Emergency SOS and any safety-related features depend on your device, sensors, battery, network coverage, and third-party providers, and may fail or be unavailable. They are NOT a replacement for calling your local emergency services (e.g., 911/112/1122). Do not rely on the App in an emergency.

You assume all risks arising from your use of the App while travelling. To the maximum extent permitted by law, we are not liable for accidents, injuries, losses, fines, or damages resulting from your use of, or reliance on, the App.

The App uses your device location, including in the background during active navigation or trip tracking, to provide its core features. You can disable location permissions in your device settings, but navigation and tracking features will not work without them. Our handling of location and other data is described in our Privacy Policy.

"User Content" means anything you submit through the App, including trips, reviews, ratings, profile information, photos, and notes.

• You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, display, and distribute your User Content solely to operate, provide, and improve the App (for example, showing your public profile, trips, and reviews to other users).
• You are solely responsible for your User Content and confirm you have the rights to share it.

We may, but are not obligated to, review, moderate, remove, or restrict User Content or accounts that we believe violate these Terms, without notice.

• The App offers a free tier and paid subscription plans (e.g., Bi-Yearly and 5-Year), with features and prices shown in the App. Prices may change; changes apply to future billing periods.
• Purchases and subscriptions are processed by the Apple App Store or Google Play, not directly by us. Payment is charged to your app-store account at confirmation of purchase.
• Auto-renewal: Subscriptions automatically renew at the then-current price unless you cancel at least 24 hours before the end of the current period. Your app-store account is charged for renewal within 24 hours prior to the end of the period.
• Manage / cancel: You manage and cancel subscriptions in your Apple App Store or Google Play account settings. Deleting the App does not cancel a subscription.
• Refunds: Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods. Refund requests are handled by Apple or Google under their policies.
• Free trials / promotions (if offered): any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.

You are responsible for any taxes and for charges from your carrier or app store.

The App relies on third-party services, including Mapbox, OpenRouteService, Photon/Komoot, Open-Meteo, the app stores, and our notification provider. Your use of features powered by these services may be subject to their terms, and we are not responsible for third-party services, their availability, or their content.

The App, including its software, design, text, graphics, logos, and content (other than User Content), is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial use in accordance with these Terms. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works from the App or any part of it, except as permitted by law.

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms;
• Interfere with or disrupt the App, its servers, or networks, or attempt to gain unauthorized access;
• Use bots, scrapers, or automated means to access or collect data from the App;
• Circumvent usage limits, security, rate limits, or subscription restrictions;
• Misuse other users' personal or location information.

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and share information. By using the App, you consent to those practices.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT MAPS, ROUTES, LOCATION, SPEED LIMITS, WEATHER, OR OTHER DATA WILL BE ACCURATE, COMPLETE, OR CURRENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR FOR PERSONAL INJURY OR PROPERTY DAMAGE, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP, INCLUDING ANY RELIANCE ON NAVIGATION, ROUTES, OR SAFETY FEATURES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU; NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.

You agree to indemnify and hold harmless NavigateMoto and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the App, your User Content, or your violation of these Terms or of any law or third-party right.

We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or if we discontinue the App. You may stop using the App and delete your account at any time (see the Privacy Policy for account deletion). Sections that by their nature should survive termination (including Sections 6, 9, 12, 13, 14, and 16) will survive.

These Terms are governed by the laws of Pakistan, without regard to conflict-of-law rules. You agree that the courts located in Karachi, Pakistan will have jurisdiction, except where applicable consumer-protection law gives you the right to bring proceedings in your local courts. Where required by law, you retain all mandatory statutory rights as a consumer.

We may update these Terms from time to time. We will post the updated Terms in the App and/or on our website and update the "Last updated" date. Material changes will be communicated where appropriate. Your continued use of the App after an update means you accept the revised Terms.

If you downloaded the App from Google Play, your use is also subject to the Google Play Terms of Service.
